1. Provider
These terms of service apply to the use of the EverAct Mobile Application. By downloading, installing, or using the app, you agree to these terms.
2. Token System and ECO Token

Testnet → Mainnet
Tokens are currently issued on the Sonic Testnet. Migration to Sonic Mainnet is planned. Risks are associated with migration.
3. Fee Structure (3%)
A fee of 3% applies to each token distribution.
The fee is automatically deducted from the gross distribution amount.

Purpose of fee: Blockchain transaction costs (gas), server and infrastructure costs, development and maintenance costs.

Store Mode
When blockchain gas costs exceed the economic threshold, token distribution is delayed. Tokens are stored in the smart contract. Users can claim their tokens after approximately 7 days.
5. Health Data and Permissions
Using certain features of the app requires access to Apple HealthKit data:
- Steps (Step Count)
- Workouts (Training sessions)
- Active Calories
Consent
Access to HealthKit requires your express consent. You can revoke this consent at any time in iOS settings.
No Commercial Use: Your health data is not used for advertising, marketing, or data sales.
6. Receipt Scanning
The following data is processed:
- Extracted text from the receipt (via OCR)
- Merchant name, date, total amount
- A unique fingerprint (Fingerprint) for duplicate detection
Important: Photos of receipts are not stored.
Receipt data is stored for a maximum of 2 days and then automatically deleted.
7. Wallet and Account Security
EverAct uses Thirdweb for wallet authentication with the following options:
User Responsibility
If the private key or seed phrase is lost, tokens cannot be recovered. The company has no access to your wallet credentials.
8. Smart Contract Risks
Execution as Implemented
Program errors, security vulnerabilities, or code deficiencies may lead to partial or complete loss of tokens.
Irreversibility
Smart contract transactions are irreversible after execution. Tokens cannot be retrieved if the wallet address is entered incorrectly.
Oracle Dependency
Smart contracts depend on external data sources (Chainlink Oracle). Token distribution may be delayed if the oracle fails.
Gas Costs
Transaction gas costs can fluctuate significantly. During high network congestion, transaction costs can be substantial.
9. Token Value and Financial Information
No Guaranteed Value
The value of tokens is subject to significant fluctuations and may become worthless. Past performance is not a guarantee for future results.
No Investment Advice
The provision of tokens or the use of this app does not constitute investment advice. Users act at their own responsibility.
Tax Responsibility
Token earnings may be taxable. Users are responsible for proper reporting and payment of taxes. Consult a tax advisor.
No Deposit Protection: ECO tokens are not deposits under German deposit protection law. There is no claim to reimbursement in case of loss.
10. Liability and Limitation of Liability
We are liable for:
- Intent and gross negligence
- Breach of cardinal obligations
In case of slightly negligent breach of non-essential contractual obligations, liability is limited to foreseeable damages typical for the contract.
Not liable: For indirect damages, especially lost profits, as well as for damages caused by events beyond our control.
11. Right of Withdrawal
You have the right to withdraw from this contract within 14 days without stating reasons.

12. Dispute Resolution

German law applies to these terms of service and the entire legal relationship. Place of jurisdiction is Taunusstein.
The provider is not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
